The Milwaukee man stands trial for the shooting death of a 13-yr-old in 2012. He shot the boy when he was disposing the trash. Spooner conjectured that Darius had stolen

 $ 3,000 worth short guns from him and claimed that the sixth-grade restore them back.
    While Simmons abjured that he did not take them, Patricia Larry, his mother was asking him to go back home. In all the commotion, Spooner took out a handgun and shot the boy in the chest from near point range.

        Spooner was still holding on to the gun when the police arrived. He told the police,"Yeah, I shot him." The boys autopsy confirmed that he was unarmed. Spooner was convicted with first degree murder. He beseech-ed not guilty due to aberration.

Spooner’s porch captured the entire incident and show  Simmons threatening and eventually shooting the frightened teen.

      Milwaukee Mayor Tom Barrett damned the assassination. " Too have a boy who;s taking out the garbage at 10:30 in the morning murdered should shock the conscience of the state," Barrett said at that time.
       A few hours before the shooting, Spooner had told a local politician that he was disappointed that the police did not arrest the boy for larceny. He wanted to take law in his own hands.
     Spooner's case has been compared to Zimmerman's killing of 17-yr-old Travyon for the reason seems to be the same - neighborhood vigilance.

      In 2012 Rev. Jesse Jackson's Rain flow PUSH Coalition called Spooner to be charged with leagued animus behavior.
      On this Monday, the Simmons's family attorney said that it is a clear case of "issue of Profiling and a race component of the case. But Spooner abjured that kindred was the reason in the shooting.
      The trail was to begin in January. But it was postponed due to the sickness of Spooner. He is suffering from Pneumonia.
